DATA PROTECTION POLICY

Having registered in the reservation system, the user accepts that the personal data provided or that will be provided in the future to Hotel Moon may be included in a personal data file. This data may be used for marketing purposes to compile statistics, to forward advertisements, offers and promotions, to conduct competitions with prizes, to administer the reservation service and to manage incidents unless the user notifies his/her opposition thereto at the address that is indicated below.

The above-stated files shall be held by Hotel Moon. The owner of the data may at all times access the files and is entitled to rectify, cancel and oppose the administration thereof in accordance with the provisions that are set out in the Spanish legislation governing data protection. For the said purpose, the owner of the data shall send a signed letter to Hotel Moon at the following address: Ramón y Cajal, 47 , 15006 A Coruña, A Coruña, indicating the owner’s address so that Hotel Moon may return to the same a confirmation of the relevant actions that have been taken to resolve the problem in accordance with the request of the owner in question.

The provision of all such data as is required for registration as a user is mandatory, and Hotel Moon may reject the registration of the interested party should the latter fail to provide such data.

The owner of the data expressly authorises Hotel Moon to grant access to his/her data to those companies that are owned by the said hotel for the purpose of handling the said data as well as to other institutions which, by law, may have access thereto for the purpose of providing the user with the service under agreement.

The consent given by the user to have his/her data handled and provided to the above-stated parties may be revoked at all times by written letter of notice to the party that is responsible for the file, Hotel Moon, at the above-stated address. The said notice shall be signed by the owner of the data, who shall indicate his/here address therein.

Hotel Moon has implemented all the security measures as are legally required for the protection of all personal data provided by the user. Hotel Moon cannot, however, guarantee the absolute invulnerability of its security system nor can it guarantee the security or the inviolability of the said data while it is being transmitted over the internet.

TERMS AND CONDITIONS OF THE AGREEMENT: ADVANCE PAYMENTS AND CANCELLATIONS

At the moment of making the reservation, the client will be asked for a credit card number for the purpose of paying the following amounts for the reservation:

If the client is reserving a ROOM:

A) For less than ten (10) days: The price of occupying the room for one day.
B) For more than ten (10) days: The price of occupying the room for one day out of each ten(10) days or fraction thereof.

If the reservation of the room is not cancelled with prior notice of at least seven days of occupying the room, the client shall forfeit the reservation payment.

If the client is reserving an APARTMENT:

A)40% of the total price if the reservation is made for less than one (1) month.
B) A)25% of the total price if the reservation is made for more than one (1) month.

In the case of Apartments, 5% of the reservation payment shall be withheld in the event that cancellations are made with prior notice of more than one month. 50% shall be withheld if the cancellation is made with prior notice of less than thirty (30) days and more than seven days (7). 100% of the reservation shall be withheld by the hotel if the reservation is cancelled with prior notice of only seven days or less, giving rise to a forfeit by the client of the total reservation payment.

TERMS AND CONDITIONS OF ACCESS AND USE OF THE PORTAL.

1. The technical requirements of access:
To access the portal, the USER will have to have access to the internet, to pay the corresponding access and connection fees and to have the equipment and information systems that are necessary to connect to the web, including a terminal that is appropriate for the purpose (such as a computer and telephone) as well as a modem or another similar access device. For the correct access to and use of certain content and services of the portal, certain computer programs or other logical elements will have to be downloaded to your computer. The price of this installation shall be borne by the USER, and Hotel Moon declines all such responsibility as might derive therefrom.

2. Obligation to make the correct use of the Portal, the Services and the Content:
a) THE USER
The USER agrees to use the portal, the services and the content as well as the terms and conditions hereunder in compliance with the law, moral, good conduct and public order.
The user is bound to use the portal, the services and the content diligently, correctly and lawfully; in particular he/she shall refrain from:
1/ Reproducing and copying, distributing, and permitting access by the public across any public communication system as well as transforming and modifying the contents unless the user is authorised to do so by the holder of the rights thereof or that such action is legally permitted;
2/ Deleting, avoiding and manipulating the copyright and other identifying data of the right of the holders that are included in the content, as well as the protection devices or any other information mechanism that the content might contain.
3/ Using the forum that is provided by Hotel Moon to post messages that are not directly related to the theme of the forum, in particular, those that have illegal, illicit or libellous content or any other kind of content that might be detrimental to third-party rights or that might damage information systems. Hotel Moon reserves the right to withdraw any message that it deems to be inappropriate.
In addition, the user is bound to diligently safeguard and keep secret the passwords that are provided by Hotel Moon and to accept the consequences or the economic damage that might be suffered due to a lack of diligence in safeguarding the said passwords.

b) The portal:
Hotel Moon does not control or guarantee the absence of virus or other elements in the content that might alter the information system (both software and hardware) or in the electronic documents and files that are stored in the user’s information system

3. Denial and withdrawal of access to the portal and/or services:
Hotel Moon reserves the right to deny or withdraw access to the portal and/or services at any time without issuing prior notice to those USERS who fail to comply with the terms and conditions here under.

4. Use of the services offered in the portal of Hotel Moon in compliance with the Unapproved Advertising Policy that is regulated by the Spanish Information Society Services and Electronic Commerce Act (LSSICE).
Both the USER and Hotel Moon are bound to use the services in compliance with the Unapproved Advertising Policy, and in particular, shall adhere to the following:
- Neither party shall send unsolicited electronic message chains.
- In the event that Hotel Moon sends advertisements to the users, the said advertisements shall include the word “publicidad” (advertising) in the interest of avoiding confusion.
Users who receive unsolicited mail that is directed to a large number of people may notify Hotel Moon thereof by sending a message to the following email account: reservas@mooncoruna.com
